1. General
These Terms & Conditions govern your use of our website and the purchase of products from Desacne.
By placing an order, you acknowledge and agree to these Terms & Conditions.
We reserve the right to update these Terms at any time without prior notice.
2. Nature of Products & Condition
Desacne specialises in sealed trading card products and collectible items sourced directly from authorised distributors.
Due to the nature of these products, Desacne does not have control over the condition in which items are received from suppliers.
Products may display minor imperfections, including but not limited to:
- Small tears
- Minor dents
- Light seal irregularities
These are considered standard condition and are not classified as defects.
Desacne will not dispatch items with major damage, including:
- Crushed packaging
- Completely opened or broken seals
- Significant structural damage
3. Standard vs Premium Service
Desacne offers two fulfilment options:
Standard Service
Products are:
- Taken directly from a case
- Placed into protective packaging
- Dispatched without individual condition review
By selecting Standard Service, you acknowledge and accept the inherent variability in product condition.
Premium Service
Premium Service includes:
- Manual inspection of the product
- Photographs provided for customer approval prior to dispatch
This service is designed to maximise the likelihood of receiving the best available condition product.
Dispatch will only occur once approval is received. Delays may occur if approval is not provided in a timely manner.
4. No Change of Mind Returns
Desacne does not accept returns for change of mind.
This includes all sealed trading card products and collectibles.
All sales are considered final once dispatched, subject to your rights under applicable law.
5. Returns & Restocking (Discretionary)
Returns are not accepted as standard policy.
However, in limited cases and at Desacne’s sole discretion, a return may be approved.
Where a return is approved:
- A 20% restocking fee will apply
- Desacne will provide a return shipping label
- The product must be returned in its original, unopened, and resellable condition
Once the item is received and inspected, a refund will be issued minus the restocking fee.
Returns that do not meet these conditions may be refused.
6. Faulty or Incorrect Items
If you receive an item that is:
- Incorrect, or
- Significantly damaged beyond what is outlined in Section 2
You must contact us within 48 hours of delivery with clear photographic evidence.
We will assess and resolve the issue in accordance with the Australian Consumer Law.
7. Click & Collect / Order Collection
For all collection orders:
- The original purchaser must attend
- Valid government-issued ID must be presented
- The name must match the order
Orders will not be released to third parties.
8. Uncollected Orders
Orders that are not collected within one (1) month of notification may, at Desacne’s discretion:
- Be cancelled and refunded, or
- Be restocked and resold
Repeated failure to collect orders may result in:
- Temporary or permanent restrictions on future purchases
If additional time is required, customers must communicate this in advance.
9. Shipping & Risk
Once an order has been dispatched:
- Delivery times are estimates only
- Risk transfers to the customer upon delivery
Desacne is not responsible for delays caused by shipping carriers.
10. No Guarantee of Contents
Desacne does not guarantee:
- Specific cards
- Pull rates
- Rarity outcomes
All products are sold as issued by the manufacturer.
11. Fraud Prevention & Order Verification
Desacne reserves the right to:
- Request identification
- Cancel or refuse orders suspected of fraudulent activity
12. Limitation of Liability
To the extent permitted by law, Desacne shall not be liable for:
- Indirect or consequential losses
- Loss of profits or opportunity
Nothing in these Terms excludes your rights under the Australian Consumer Law.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia.
